I caought my husband texing my brothers girlfriend all day and everyday is this cheating?

they were texting from about 6 am to about 10pm and they would call eachother in between he is a construction worker and his job is hands on so when i called he would say i cant talk but with her he was texting all day like 4 or 5 text per hour is this cheating ?
